Win in Range Official Rules.

These are the Official Rules of the Win in Range Sweepstakes operated by Around The Hoop Holdings, LLC. By entering, you agree to be bound by these Rules and the decisions of the Sponsor.

No Purchase Necessary to Enter or Win.A purchase or payment will not improve your chances of winning. Void where prohibited. The Win in Range Sweepstakes is not affiliated with, sponsored by, or endorsed by Dexcom, Inc.
Section 01

Sponsor & Promotion

The Win in Range Sweepstakes (the “Sweepstakes”) is sponsored by Around The Hoop Holdings, LLC, a Massachusetts limited liability company with its principal place of business at 888 Worcester St, Suite 130, Wellesley, MA 02482 (“Sponsor”). The Sweepstakes is operated by Sponsor in connection with its consumer wellness service marketed under the name “Win in Range.”

Section 02

Eligibility

The Sweepstakes is open only to natural persons who, at the time of entry, are: (a) legal residents of the fifty (50) United States or the District of Columbia, excluding the states of Florida and New York; (b) physically located within the eligible jurisdictions; and (c) at least eighteen (18) years of age or the age of majority in their state of residence, whichever is older.

Excluded jurisdictions: Florida, New York, Puerto Rico, the U.S. Virgin Islands, and all other U.S. territories and possessions. Void where prohibited or restricted by law.

Employees, officers, directors, members, managers, contractors, and agents of Sponsor and its parents, subsidiaries, affiliates, advertising and promotion agencies, and any other entity involved in the development, production, implementation, administration, or fulfillment of the Sweepstakes (collectively, “Sweepstakes Entities”), and the immediate family members (spouse, parents, siblings, children, and their respective spouses, regardless of where they reside) and members of the same household (whether related or not) of any of the foregoing, are not eligible to enter or win.

Participation constitutes the entrant's full and unconditional agreement to and acceptance of these Official Rules and Sponsor's decisions, which are final and binding in all matters relating to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.

Section 03

Sweepstakes Period

The Sweepstakes is conducted in consecutive weekly drawing periods (each, an “Entry Period”). Each Entry Period begins at 12:00:00 AM Eastern Time on Monday and ends at 11:59:59 PM Eastern Time on the following Sunday. Sponsor's computer is the official timekeeping device for the Sweepstakes.

The Sweepstakes commences on [FILL IN: launch date] and continues on a rolling weekly basis until terminated by Sponsor in its sole discretion, with reasonable advance notice posted at wininrange.com.

Section 04

How to Enter

There are two (2) methods to obtain entries into a weekly drawing. Each entry obtained via Method A and Method B has equal weight in the random drawing. No purchase or payment is necessary to enter or win.

Method A — CGM-Based Entry:

Eligible entrants who voluntarily create a free Win in Range account at wininrange.comand authorize a one-time read-only connection to their Dexcom continuous glucose monitor (“CGM”) account may earn entries based on their daily Time-in-Range performance during an Entry Period. At account creation, Sponsor calculates each entrant's individual Time-in-Range baseline(the “baseline”) as the median daily TIR from the trailing sixty (60) days of the entrant's Dexcom data. The baseline is initially set at account creation and may be periodically recalibrated by Sponsor at its discretion, including (without limitation) to reflect updated player data, address technical errors, or maintain fairness across the player population. Sponsor will not retroactively adjust entries that have already been awarded under a prior baseline.

For each calendar day during the Entry Period on which the entrant's daily TIR percentage, as reported by Dexcom, exceeds the entrant's baseline, the entrant earns one (1) drawing entry. If the entrant exceeds baseline on all seven (7) calendar days of an Entry Period (a “Perfect Week”), the entrant earns three (3) additional bonus entries.

The total number of Method A drawing entries earned per Entry Period is calculated as follows:

Entrants who join Win in Range mid-week may earn entries for any qualifying days remaining in the current Entry Period. The Perfect Week bonus requires exceeding baseline on all seven (7) days of an Entry Period and is therefore not available during a partial first week.

Method B — Free Mail-In or Online Entry (Alternate Method of Entry / “AMOE”):

To enter without connecting a CGM, eligible entrants may either:

  1. Online Free Entry: Visit wininrange.com/free-entryduring an Entry Period and complete the free-entry form, providing the entrant's full legal name, mailing address, email address, date of birth, and the calendar week of the Entry Period for which the entry is intended. One (1) entry will be awarded per validly submitted online free-entry form.
  2. Mail-In Free Entry: Hand-print the entrant's full legal name, mailing address, email address, date of birth, and the words “Win in Range Free Entry — Week of [calendar date of the Monday on which the relevant Entry Period begins]” on a 3” x 5” card, and mail the card in a #10 envelope to: Win in Range Sweepstakes, Free Entry, 888 Worcester St, Suite 130, Wellesley, MA 02482. Mail-in entries must be postmarked during the relevant Entry Period and received within seven (7) calendar days after the close of that Entry Period to be eligible. One (1) entry will be awarded per validly submitted mail-in card. Mechanically reproduced or photocopied entries will not be accepted. Mail entries are limited to one entry per envelope.

Sponsor is not responsible for lost, late, illegible, incomplete, postage-due, misdirected, or undelivered entries, technical malfunctions, or for entries not received for any reason.

Section 05

Entry Limits

Limit: one (1) Win in Range account per natural person. An entrant may earn up to ten (10) Method A entries per Entry Period and submit one (1) Method B entry per Entry Period, for a maximum of eleven (11) total entries per Entry Period per person. Multiple accounts, duplicate entries, or entries submitted on behalf of another person will be void.

Use of any robotic, automated, programmed, or similar entry methods or agents is prohibited and will result in disqualification.

Section 06

Winner Selection & Odds

For each Entry Period, one (1) potential winner will be selected in a random drawing from among all eligible entries received during that Entry Period. The drawing will be conducted on or about 12:30 AM Eastern Time on the Monday immediately following the close of the Entry Period, by Sponsor or its designated administrator, using a verifiable random selection method.

Odds of winning depend on the total number of eligible entries received during the relevant Entry Period. Sponsor's decisions in all matters relating to the Sweepstakes, including the selection and verification of winners, are final and binding.

Section 07

The Prize

One (1) prize will be awarded per Entry Period: One Thousand U.S. Dollars ($1,000.00 USD), payable by ACH bank transfer or, at Sponsor's option, by paper check mailed to the verified winner's mailing address. The Approximate Retail Value (“ARV”) of the prize is $1,000.00. Total ARV across the calendar year is approximately $52,000.00.

Prize is non-transferable. No substitution or cash redemption (other than the cash prize itself) will be permitted, except by Sponsor in its sole discretion. Sponsor reserves the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable for any reason.

Section 08

Winner Notification

The potential winner will be notified by Sponsor via email at the address on file (for Method A entrants) or the address provided on the entry form (for Method B entrants). The potential winner will be required to respond and provide reasonable verification information — which may include a signed Affidavit of Eligibility, Liability and Publicity Release, and IRS Form W-9 — within thirty (30) calendar days of the date of first notification (“Claim Period”).

Failure to respond within the Claim Period, return of the notification as undeliverable, refusal of the prize, or non-compliance with these Official Rules may result in disqualification, and an alternate winner may be selected at Sponsor's discretion in a random drawing from the remaining eligible entries for that Entry Period. Sponsor is not obligated to award an unclaimed prize.

Section 09

Taxes

All federal, state, and local income, withholding, and other taxes (if any) on prizes are the sole responsibility of the winner. Because the prize value exceeds $600.00, Sponsor will issue an IRS Form 1099-MISC to the winner reflecting the amount of the prize and will report the same to the Internal Revenue Service. The winner will be required to provide a valid Taxpayer Identification Number (typically by submitting IRS Form W-9) prior to receiving the prize.

Section 10

Publicity Release

By accepting a prize, except where prohibited by law, the winner grants to Sponsor and its designees a non-exclusive, royalty-free, perpetual, worldwide license to use the winner's first name, last initial, city and state of residence, and a general statement that the winner won the Sweepstakes, in any media now known or later developed, for advertising, marketing, and promotional purposes related to the Sweepstakes and Sponsor's business, without further notice, consent, or compensation.

Sponsor will not, without the winner's separate, affirmative express consent, publish or disclose the winner's full legal name, full address, email address, telephone number, photograph or likeness, Time-in-Range data, baseline, or any other glucose, health, or biometric information.

Section 11

Liability Release

By entering, each entrant agrees to release, discharge, and hold harmless Sponsor, its parents, subsidiaries, affiliates, members, managers, officers, directors, employees, contractors, agents, and assigns (collectively, the “Released Parties”) from and against any and all claims, demands, losses, injuries, damages, liabilities, costs, and expenses of any kind whatsoever (including reasonable attorneys' fees) arising out of or in connection with: (a) the entrant's participation in the Sweepstakes; (b) the entrant's acceptance, possession, use, or misuse of any prize; (c) any technical malfunctions, errors, or interruptions in the Sweepstakes; (d) any delay or inability to deliver a prize; or (e) any human or technical error in calculating baselines, entries, or drawings.

The released parties are not responsible for any incorrect or inaccurate information, whether caused by entrants, printing errors, or by any of the equipment or programming associated with or utilized in the sweepstakes. The released parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, or unauthorized access to or alteration of entries.
Section 12

Privacy & Data Use

Information collected from entrants is governed by Sponsor's Privacy Policy, which is incorporated by reference into these Official Rules. By entering, each entrant consents to the collection, use, storage, and disclosure of their information by Sponsor as described in the Privacy Policy and these Official Rules.

For Method A entrants who authorize a Dexcom connection, Sponsor receives daily Time-in-Range percentages and limited related metadata via the Dexcom API on a read-only basis. Sponsor does not sell, rent, or license entrant glucose data, Time-in-Range data, or any other health-related information to any third party. Sponsor does not share entrant glucose data with sponsors of the Sweepstakes, advertisers, or marketing partners. Entrants may revoke the Dexcom connection at any time via the Win in Range settings page or the Dexcom platform; revocation will end the entrant's ability to earn Method A entries but will not affect prior validly earned entries.

Health data and HIPAA: Sponsor is not a HIPAA-covered entity, and the data Sponsor receives from Dexcom is not protected health information (“PHI”) in Sponsor's hands under the federal Health Insurance Portability and Accountability Act (“HIPAA”). Sponsor nevertheless treats entrant glucose data as sensitive personal information and applies reasonable administrative, technical, and physical safeguards to protect it.

Data retention. Sponsor retains entrant data only for as long as reasonably necessary to operate the Sweepstakes, comply with tax and legal obligations (including IRS reporting for prize winners), and respond to support requests. Entrants who delete their account will have their personal data deleted within thirty (30) days, except for records Sponsor is required to retain by law (e.g., tax records for prize winners).

State privacy rights.Residents of certain U.S. states (including but not limited to California, Colorado, Connecticut, Virginia, and Washington) may have additional rights with respect to their personal information, including the right to access, correct, delete, or port their data, and the right to opt out of certain processing. Entrants may exercise these rights through Win in Range's settings page or by emailing privacy@wininrange.com. Additional details are in the Privacy Policy.

Section 13

Disputes & Governing Law

Except where prohibited by law, all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of entrants and Sponsor in connection with the Sweepstakes, shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without giving effect to any choice-of-law or conflict-of-laws principles.

Each entrant agrees that any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by the state or federal courts located in Norfolk County, Massachusetts. Each entrant irrevocably consents to the personal jurisdiction of such courts and waives any objection to venue in such courts.

Each entrant further agrees that: (a) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorneys' fees; and (b) under no circumstances will any entrant be permitted to obtain awards for, and each entrant hereby waives all rights to claim, indirect, punitive, incidental, or consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

Section 14

General Conditions

Sponsor reserves the right, in its sole discretion, to disqualify any entrant found to be: (a) tampering with the entry process or the operation of the Sweepstakes or the Win in Range service; (b) violating these Official Rules; (c) acting in an unsportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten, or harass any other person; (d) attempting to manipulate Time-in-Range data through artificial means, including but not limited to falsified calibration, sensor sharing, account sharing, or any conduct designed to inflate entry counts inconsistent with the entrant's actual continuous glucose monitor readings; or (e) submitting entries on behalf of any other person.

If, for any reason, the Sweepstakes is not capable of running as planned by reason of, including but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Sweepstakes, in whole or in part, and to select winner(s) by random drawing from among all eligible, non-suspect entries received prior to action taken, or as otherwise deemed fair and appropriate by Sponsor.

Not affiliated with Dexcom. The Sweepstakes is not sponsored by, endorsed by, administered by, or affiliated with Dexcom, Inc. or any of its affiliates. Dexcom is a trademark of Dexcom, Inc., used by Sponsor solely for descriptive purposes pursuant to applicable fair-use principles.

Section 15

Not Medical Advice

The Win in Range Sweepstakes and the Win in Range service are not medical care, medical treatment, medical advice, or a substitute for the professional judgment of a licensed healthcare provider. Win in Range does not provide diagnosis, treatment recommendations, dosing guidance, or any other clinical service.

Heather Lampert, DO, is a founder and operator of Sponsor's Win in Range service. Dr. Lampert is not acting in her capacity as a treating physician with respect to entrants of the Sweepstakes, and no physician–patient relationship is created, implied, or intended between Dr. Lampert (or any other clinician affiliated with Sponsor) and any entrant by reason of an entrant's participation in the Sweepstakes or use of the Win in Range service. Communications from Win in Range — including emails, the website, the Sweepstakes drawings, and any related materials — are general consumer communications and do not constitute the practice of medicine.

Entrants should consult their own healthcare providers regarding their diabetes management, treatment plan, medications, devices, and any decisions affecting their health. Entrants should never modify, delay, or discontinue any treatment, medication, or medical device use based on participation in the Sweepstakes, the receipt or non-receipt of entries, the outcome of any drawing, or any communication from Win in Range. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room.

Time-in-Range is a single metric reported by your CGM and is not a complete picture of your health. Many factors affect Time-in-Range — including illness, stress, hormonal cycles, medications, exercise, food, sleep, and sensor performance — and a lower Time-in-Range on any given day, week, or longer period does not mean an entrant is doing anything wrong or failing in any sense. Sponsor expressly disclaims any suggestion that participants should pursue Time-in-Range numbers to the exclusion of other clinical priorities or in ways their healthcare providers would not endorse.

Winner List & Contact

Winner List. For a list of winners for any given Entry Period, send a written request along with a self-addressed, stamped envelope to: Win in Range Sweepstakes, Winner List Request, 888 Worcester St, Suite 130, Wellesley, MA 02482, or email rules@wininrange.comwith the subject line “Winner List Request” and the calendar week of the Entry Period in question. Requests must be received within ninety (90) days after the close of the relevant Entry Period.

Copy of Official Rules. A copy of these Official Rules is available at wininrange.com/rulesat all times during the Sweepstakes. To request a printed copy, send a written request along with a self-addressed, stamped envelope to the address above with the subject line “Official Rules Request.”
